GST increased on used car sales to 18%

In a significant policy shift, the Goods and Services Tax (GST) Council, led by Finance Minister Nirmala Sitharaman, has raised the GST rate on the sale of used cars from 12% to 18%.

Scope of the Tax Increase

This revised tax rate applies to all categories of used vehicles, including electric vehicles (EVs). Previously, used petrol vehicles with engine capacities of 1,200cc or more and lengths exceeding 4,000 mm, as well as diesel vehicles with engine capacities of 1,500cc or more and similar lengths, were already subject to an 18% GST. The new decision extends this uniform rate across all used vehicles sold by registered dealers.

Impact on Private Sellers

It’s important to note that this tax adjustment does not affect private individuals engaging in the sale or purchase of used vehicles. Transactions between unregistered persons remain exempt from GST. The 18% GST is applicable only to registered businesses involved in the resale of used vehicles, calculated on the margin between the purchase and selling prices.

Industry Reactions and Implications

The decision has elicited varied responses from industry stakeholders. While some view it as a move towards tax uniformity, others express concerns about potential impacts on the used car market, particularly regarding affordability and sales volume. Dealers may face increased tax liabilities, which could influence pricing strategies and profit margins.

Clarifications from the Finance Minister

Finance Minister Nirmala Sitharaman has clarified that the GST is levied on the margin—the difference between the purchase price and the selling price—when registered dealers sell used vehicles. This approach aims to ensure that the tax burden reflects the actual value addition by dealers.

Conclusion

The GST Council’s decision to increase the tax rate on used car sales to 18% marks a notable change in the taxation landscape for the automotive sector. While it seeks to standardize tax rates across vehicle categories, its practical implications on market dynamics and consumer behaviour will become evident in the coming months.
